When responsible lending obligations apply, we take the time to understand what you need, where you are today and whether the finance being considered is appropriate for your circumstances.
Understanding your position
Before providing regulated credit assistance, we make reasonable inquiries about your financial situation, requirements and objectives.
This may include understanding your:
Income and employment;
Living expenses;
Existing loans and financial commitments;
Assets and liabilities;
Borrowing purpose;
Short and longer-term plans; and
The features and flexibility that matter to you.
The aim is not simply to determine how much you may be able to borrow. It is to understand what makes sense for your circumstances.
Verifying the information
Where required, we take reasonable steps to verify relevant financial information you provide.
This may involve reviewing documents such as payslips, bank statements, tax returns, financial statements or information about existing liabilities.
Accurate and complete information helps us assess your options properly.
Assessing suitability
For regulated consumer credit, we must not provide credit assistance in relation to a credit contract if it would be unsuitable for you.
A credit contract may be unsuitable where, for example, it is likely that you would be unable to meet the financial obligations under the contract without substantial hardship, or where the contract does not meet your requirements or objectives.
ASIC describes these inquiries, verification and suitability obligations as core parts of the responsible lending framework.
Acting in your best interests
Where the mortgage broker best interests duty applies, we are required to act in your best interests when providing credit assistance.
That means looking beyond a single headline rate.
Depending on your circumstances, we may consider factors including:
Interest rates and fees;
Loan structure;
Features and flexibility;
Lender policy;
Borrowing capacity;
Your future plans; and
The overall cost and suitability of available options.
Your circumstances are individual. The finance solution should be too.
Your role
Good lending decisions rely on good information.
We ask that you provide information that is accurate, complete and current and let us know if your circumstances change while we are assisting you.
If something is unclear, ask us. We want you to understand the options being considered and the decisions you are making.
